Terms of Service

These Terms of Service ("Terms") govern your access to and use of ENDSCREEN, a mobile application operated by Shred Level, LLC ("Shred Level," "we," "us," or "our"), headquartered in New York, United States. By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years of age (or the minimum age required in your jurisdiction) to use ENDSCREEN. By using the App, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.

2. Description of Service

ENDSCREEN is a retro-gaming community platform designed for arcade and classic gaming enthusiasts. The App enables users to capture, submit, and verify arcade score data through camera-based OCR scanning, participate in bounties, and engage with leaderboard and community features.

3. Account Registration

You may be required to create an account using a valid email address and a user-selected username. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at admin [at] shredlvl [dot] com if you suspect unauthorized access.

ENDSCREEN may offer optional subscription tiers processed through the Apple App Store, Google Play Store, and RevenueCat. Subscription fees, billing cycles, renewal terms, and cancellation procedures are governed by the applicable platform's terms. Shred Level, LLC does not process direct payment card transactions for subscriptions within the App.

6. User Conduct

ENDSCREEN is a retro-gaming community platform. While spirited arcade banter is expected within the community, you agree not to:

• Upload, transmit, or distribute illegal content, including content that infringes intellectual property rights or violates applicable law;
• Fake, forge, manipulate, or misrepresent score screenshots or OCR scan results, including through photo editing, screen overlays, replay attacks, or any other method designed to deceive the verification system;
• Interfere with, reverse-engineer, or circumvent OCR scanning, leaderboard metrics, or anti-fraud systems;
• Engage in targeted harassment, hate speech, threats, doxing, or sustained personal attacks outside the scope of standard competitive gaming banter;
• Impersonate another user, Shred Level staff, or any third party;
• Use automated scripts, bots, or unauthorized tools to interact with the App or manipulate rankings;
• Exploit bugs, glitches, or vulnerabilities for unfair advantage rather than reporting them responsibly.

7. Score Verification & Camera Use

By submitting score photographs through the App, you grant Shred Level, LLC a non-exclusive license to process, store, and analyze those images for OCR verification, leaderboard integrity, and enforcement purposes as described in our Privacy Policy. You represent that all submitted images are authentic captures of legitimate gameplay on the hardware and game title indicated.

8. Account Termination & Enforcement

Shred Level, LLC reserves the right, in its sole discretion, to suspend, terminate, or permanently ban any user account, and to wipe or invalidate telemetry data (including scores, bounty records, and stored verification images), for any user found to be:

• Manipulating the OCR scanner or submitting fraudulent score screenshots;
• Artificially inflating or distorting leaderboard metrics;
• Violating these Terms or any applicable law;
• Engaging in conduct that harms the integrity of the platform or its community.

Termination may occur with or without prior notice. Upon termination, your right to access the App and any associated Credits ceases immediately. No refund of subscription fees is owed for terminations resulting from Terms violations, except where required by applicable platform policy or law.

9. Intellectual Property

The App, including its design, code, trademarks, logos, and original content, is owned by Shred Level, LLC and protected by intellectual property laws. Game metadata provided through third-party sources such as IGDB remains subject to those providers' terms. You may not copy, modify, distribute, or create derivative works of the App without our prior written consent.

10. User-Generated Content

You retain ownership of content you submit (including usernames and score verification images). By submitting content, you grant Shred Level, LLC a worldwide, royalty-free license to use, store, display, and process that content solely to operate and improve the App. You represent that you have all necessary rights to submit such content.

11. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. SHRED LEVEL, LLC DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT OCR RESULTS WILL BE ACCURATE IN ALL CASES. USE OF THE APP IS AT YOUR SOLE RISK.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SHRED LEVEL, LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL SHRED LEVEL, LLC'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE APP EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO SHRED LEVEL, LLC FOR SUBSCRIPTION SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100.00).

13. Indemnification

You agree to indemnify, defend, and hold harmless Shred Level, LLC and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the App, your violation of these Terms, or your violation of any third-party rights.

14. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to conflict-of-law principles. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in New York, New York, and you consent to the personal jurisdiction of such courts.

15. Changes to These Terms

We may revise these Terms at any time by updating the Effective Date and posting the revised version within the App or on our website. Material changes will be communicated where required by law. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
